1. Agreement to Terms

By accessing or using Harvey (هارفي) mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Enova Studio ("Company," "we," "us," or "our").

2. Description of Service

Harvey (هارفي) is a mobile application that provides:

• Food and product ordering services
• Delivery services
• Payment processing
• User account management
• Order tracking

The App connects users with restaurant branches and delivery services operated by Enova Studio or its partners.

3. Eligibility

To use our App, you must:

• Be at least 18 years old, OR
• Be at least 13 years old with parental/guardian consent
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws

By using the App, you represent and warrant that you meet these eligibility requirements.

4. User Accounts

4.1 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• One account per person

4.2 Account Security

• You are responsible for all activity under your account
• Notify us immediately of unauthorized access
• We are not liable for losses due to unauthorized account use

4.3 Account Termination

We may suspend or terminate your account if you:

• Violate these Terms
• Provide false information
• Engage in fraudulent activity
• Abuse our services or staff

You may delete your account at any time through the App settings.

5. Orders and Payments

5.1 Placing Orders

• All orders are subject to availability
• Prices are displayed in YER (Yemeni Rial)
• Prices may change without notice
• We reserve the right to refuse any order

5.2 Payment

• Payment is required at time of order
• We accept: Credit/Debit Cards, PayPal, Stripe, Cash on Delivery
• All payments are processed by third-party providers
• You agree to pay all charges incurred

5.3 Pricing and Taxes

• Prices include applicable taxes unless stated otherwise
• Delivery fees are displayed before order confirmation
• Promotional discounts are subject to terms and conditions

5.4 Order Cancellation

• Orders may be cancelled before preparation begins
• Refunds for cancelled orders will be processed within 3-5 business days
• We reserve the right to cancel orders due to unavailability

5.5 Refunds

• Refund eligibility is determined case by case
• Contact customer support for refund requests
• Refunds are processed to the original payment method

6. Delivery

6.1 Delivery Areas

• Delivery is available in designated service areas
• Service areas are displayed in the App

6.2 Delivery Times

• Estimated delivery times are provided but not guaranteed
• Delays may occur due to traffic, weather, or high demand
• We are not liable for delays beyond our control

6.3 Delivery Address

• You must provide accurate delivery information
• Additional charges may apply for incorrect addresses
• We are not responsible for failed deliveries due to incorrect information

6.4 Receipt of Delivery

• Orders must be received by you or an authorized person
• Proof of delivery may be required
• Unclaimed orders may be disposed of after 30 minutes

7. User Conduct

You agree NOT to:

• Use the App for illegal purposes
• Provide false or misleading information
• Interfere with App operation
• Attempt to gain unauthorized access
• Harass or abuse our staff or delivery personnel
• Use automated systems to access the App
• Resell products purchased through the App
• Violate intellectual property rights

8. Intellectual Property

8.1 Our Property

The App and its contents, including but not limited to:

• Software and code
• Design and graphics
• Logos and trademarks
• Text and images

Are owned by Enova Studio and protected by intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer the App
• Use the App for commercial purposes without permission
• Remove copyright or trademark notices

9. User Content

9.1 Your Content

You retain ownership of content you submit (reviews, photos, etc.).

9.2 License to Us

By submitting content, you grant us a non-exclusive, royalty-free license to use, display, and distribute your content in connection with our services.

9.3 Content Standards

Your content must not:

• Be false, misleading, or defamatory
• Infringe on others' rights
• Contain illegal or offensive material
• Contain spam or advertising

We may remove content that violates these standards.

10. Disclaimers

10.1 "As Is" Basis

10.2 No Guarantee

We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of information
• Results from using the App
• Compatibility with all devices

10.3 Third-Party Content

We are not responsible for third-party content, products, or services accessed through the App.

11. Limitation of Liability

11.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENOVA STUDIO SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Personal injury (except where caused by our negligence)

11.2 Maximum Liability

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

11.3 Exceptions

Some jurisdictions do not allow limitation of liability. In such cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless Enova Studio, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Yemen.

13.2 Dispute Resolution

Any disputes shall be resolved through:

1. Informal Resolution: Contact us first to resolve the issue
2. Mediation: If informal resolution fails
3. Arbitration/Courts: As a last resort, in courts of Yemen

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

14. Changes to Terms

We may modify these Terms at any time. Changes are effective when posted. Continued use of the App after changes constitutes acceptance of modified Terms.

We will notify you of significant changes through:

• In-app notifications
• Email (if provided)
• Updated "Last Updated" date

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

15.3 Waiver

Failure to enforce any right does not waive that right.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.

15.5 Force Majeure

We are not liable for failures due to circumstances beyond our control (natural disasters, war, pandemic, etc.).
